JACOB WALKER WILL

In the name of God Amen. I Jacob Walker of the State of North Carolina Rutherford County being sick and badly diseased but of sound and disposing memory do this fifth day of May in the year of our Lord one thousand eight hundred and fourty two make and publish this my last Will and Testament revoking and setting aside all former Wills and Testaments by me made.

First I recommend My Soul to God who gave it my body to the Earth from whence it came and as touching my worldly Estate I dispose Bequest devise the same in the followign manner Viz:

Second. I will and devise that my Executor take charge of all my Estate which I die in possession of and out of the same pay all my just debts as soon as convenient.

Third. I will and devise unto my daughter Harrit my tow negro gilrs named Eliza and Clearsy and one hundred dollars in money.

Fourth. I give and bequeath to my daughters Mary, Elizabeth, Lila and Sarah Ann one hundred and fifty dollares each more than their equal share.

Fifth. I will and devise that the balance of my Estate be equally divided between my children named: John, James, Joseph, Felix, Stanhope, Andrew, George, Mary, Elizabeth, Lila and Sarah Ann.

Sixth. I furthermore give in trust to my son Felix all that share and interest in my Estate above bequeathed to my son Joseph to be given to him as my son Felix may see that he needs the same. I furthermore will and devise if my son Felix should desire I will and devise my son Stanhop to take in trust the same in like manner as above mentioned.

Seventh. Furthermore WIll and devise that my daughters and son George shall have a support for one yeawr out of the present crop now growing to be provided for by my Executor.

Eighth. I furthermore will and devise that my children that is yet single and all now living with me all have the beds and all things pertaining to them to be equally divided among them. I furthermore will and devise that my sons divided my real estate among them if they can with convenience and if they can that shall pay to my daughers Mary, Elizabeth, Lila and Sarah Ann the lawful interest on their parts or portions.

Ninth. I furthermore will and devise that if my executors think it best to sell my land that they will provide a home for my daughters if desired by them.

Tenth. I here will and devise, nominate and appoint my sons John W. Walker and James M. Walker my Executors to this my last will and testament. Signed and Acknowldeged by the Testator as the last will and testament this day and date above written.

In the presence of us: James. M. Miller, Jason McKiney Matilda Higgins, her mark,J. Walker (seal) Jos. M. Black, I hereby certify that the above is a true and accurate copy of the will of Jacob Walker, as recorded in Book E of Wills at page 102-103 in the records of my office (June 1939)
